Shipping and Deliveries
1. GENERAL CONDITIONS FOR SHIPPING AND DELIVERY
1.1. It is the customer's responsibility to check whether the items they have selected and purchased are intended for their intended use, ensuring that they have the desired characteristics in terms of shape, dimensions, color and comfort.
1.2. It is the customer's responsibility to confirm in advance whether the items purchased have the appropriate dimensions for the space where they are to be placed and whether access to the delivery location allows them to pass through.
1.3. The VIVA Online Store ships orders to mainland Portugal and the islands, Germany, Belgium, Spain, France, Italy, the United Kingdom, Switzerland and Ireland.
1.4. All orders are subject to shipping costs, unless subject to current campaigns. The shipping cost is calculated automatically based on the delivery address, date and time, total weight of the order and is included in the final order value.
1.5. To find out in advance the shipping cost for a destination outside Portugal, please contact our customer service department by telephone on 960 165 494 (call cost to mobile networks ) or by email clientes@lojavivaonline.com.
1.6. After payment has been made, the order is expected to be delivered within 72 hours. If payment is received before 12:00, the order may be delivered within the following 24 hours throughout mainland Portugal, except during periods of high order processing volume, and except for orders placed between Friday and Sunday. All delivery dates indicated are provisional and are subject to logistical factors and stock availability.
1.7. The agents used to deliver orders are DPD or one of the VIVA transport companies. Regardless of the product you have chosen, we ensure a quality delivery service. To this end, we choose the ideal type of transport according to the characteristics of your order and your products. In any case, as soon as you receive your order, we recommend that you check it with the courier.
1.8. For home delivery purposes, the DPD distribution center will contact the customer using the information contained in their form to inform them of the delivery date by sending a telephone message (SMS). Only the estimated delivery date will be mentioned as indicated in the previous point.
1.9. A code is also provided in the telephone message (SMS) which allows you to locate your order at any time using a computerized search system.
2.0. Deliveries will be made on working days before 6:00 p.m. If the customer is not at home at the time of delivery, DPD will make a second delivery attempt. If this delivery fails, the order will be returned to VIVA Online's facilities.
2.1. The Customer may choose whether to receive the item at an address of their choice or at a VIVA store of their choice, depending on the type of item and subject to the in-store delivery conditions.
2.2 . For in-store collection purposes, the order must be collected from the store where you selected collection. Collection hours correspond to the store's opening hours, which are from 10:00 a.m. to 7:00 p.m., every day of the week. Except for normal closing periods.
2.3. Collections in store must be made within 8 days of receiving notification that the order is ready for collection. If the Customer chooses to collect the item from a VIVA Store, he/she must collect it within 8 days of being notified to do so. If the Customer does not collect the item within the indicated period, VIVA will grant an additional period of up to 8 days for this purpose, after which the item(s) will be considered abandoned, under the terms set out in article 1318 of the civil code, which may imply the loss of the right of ownership in favour of the VIVA Store.
2.4. Whenever we understand that there is a high risk in the delivery service, and that damage may occur, VIVA Online Store will warn the customer of this possibility. A request for a liability waiver will be made to the customer, who, by agreeing, exempts VIVA Online Store from liability for any damage caused inherent to the delivery, which will be the customer's responsibility.
2.5. Orders placed on weekends and holidays will be processed on the next business day, so the estimated delivery date will be 72 hours after that day, except during periods of high order processing volume.
2.6. Deliveries outside the above-mentioned opening hours or normal periods will only be possible in exceptional situations previously agreed with the customer.
2.7. All products on our website are available for order, unless out of stock. Products available on the website have a limited stock and may therefore become unavailable without prior notice. In the event of a stock outage occurring after payment for the order, we will inform the customer of this fact with a view to rescheduling delivery as soon as the item is available or refunding the customer within a maximum period of 14 (fourteen) days from the date of becoming aware of the unavailability.
2.8. VIVA Online Store reserves the right to discontinue products presented on the website at any time without prior notice.
2.9. As set out in our General Conditions, the entity responsible for the sale of products on the website lojavivaonline.com is the company ESCOLHA VIVA – Artigos e Utilidades para o Lar, Lda., with registered office at Rua José da Fonseca Carvalho, Lote 7, 2685-869 Prior Velho, telephone: 960 165 494 (cost of call to the mobile network ) e-mail: clientes@lojavivaonline.com, taxpayer number 510379478, registered in the Lisbon commercial registry office under the same number.
